Terms and Conditions of Sale

Art. 1 – Acceptance of the general terms of sale and conclusion of the contract
The contract entered into between Brand 4B12 (hereinafter "4B12") and the Customer (i.e., the natural person making the purchase on the Site for purposes unrelated to their commercial, business, or professional activity) shall be deemed concluded upon acceptance, even if only partial, of the order by 4B12. In the event of non-acceptance of the order, 4B12 shall promptly notify the Customer.
By placing an order through the available methods via the order form on the Site (hereinafter the "Order"), the Customer declares to have reviewed all information provided during the purchase procedure and to fully accept these general terms and conditions (hereinafter the "Conditions").
These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Art. 12 of Italian Legislative Decree no. 70/2003 and Art. 51 of Italian Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014.

Art. 2 – Purchasing Procedure
The products offered for sale by 4B12 are solely those present on the 4b12.it website at the time the Order is placed, as described in the relevant product information sheets.
It is understood that the images accompanying the product description page are for informational purposes only and may not be fully representative of its features, potentially differing in color and size (also due to the internet browser and display monitors used to access the Site and view the images).
To place an Order, the Customer must complete all parts of the relevant form on the Site and submit it after carefully reviewing these Conditions, as well as the characteristics of the product(s) intended for purchase. If desired, the Customer must also request an invoice from 4B12 at the time of purchase, pursuant to Art. 22 of Italian D.P.R. no. 633/1972.
Correct receipt of the Order is confirmed by 4B12 via an email response sent to the email address provided by the Customer. This confirmation message will contain a summary of the purchase terms, as required by applicable law, as well as the details entered in the Order by the Customer, allowing them to verify the information and promptly communicate any necessary corrections.

Art. 3 – Prices and Payment Methods
All prices indicated on the Site are inclusive of taxes and VAT. Any shipping costs or payment fees will be communicated to the Customer in advance through the Site or these Conditions.
The following payment methods are available:

• Credit Card
• Paypal

In cases of purchase via Credit Card, the transaction will take place through a secure server selected by 4B12. Under no circumstances and at no stage of the payment process will 4B12 have access to the Customer's credit card information, which is transmitted via a secure connection directly to the banking institution managing the transaction. No digital archive of 4B12 will retain such data; therefore, 4B12 cannot be held liable for any fraudulent or unauthorized use of credit cards by third parties upon payment. For credit card payments, we rely on PayPal's secure gateways, but having an existing account is not required. If you already have a PayPal account, you can pay using your account credentials.

Art. 4 – Product Delivery and Shipping Costs
Purchased products will be delivered to the address indicated by the Customer in the Order within 24–72 hours, starting 24–48 hours after the Order registration date by 4B12, at the specific cost indicated on the Site prior to submitting the Order. 4B12 reserves the right to accept or decline delivery requests outside Italian or European borders.
Delivery times indicated by 4B12 are strictly indicative. Any delay relative to these estimates, or any split deliveries, shall not entitle the Customer to refuse delivery or claim compensation or indemnification.
Upon delivery of the products, the Customer is required to verify:

• That the number of packages delivered corresponds to what is indicated in the transport document.
• That the packaging is intact, undamaged, not wet, or altered in any way, including sealing materials (adhesive tape or strapping bands).

Any damage to the packaging and/or the product, or discrepancies in the number of packages or documentation, must be immediately noted by placing a specific reservation on the delivery receipt to be returned to the courier.

Any issues concerning the physical integrity, correspondence, or completeness of the products received must be reported within 7 days of delivery in accordance with the procedures set out in this document.

Art. 5 – Right of Withdrawal
Pursuant to Art. 52 of Italian Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without stating grounds and without penalty, within 14 (fourteen) business days from the date of receipt of the products.
To exercise the right of withdrawal, the Customer must send written notification to 4B12 within the specified time frame to the following email address: online@4b12.it.
In the event of withdrawal, the Customer must return the products to our warehouse within 14 (fourteen) days from the withdrawal notice, at the following address:
Brand 4B12 — Via San Crispino 3, 45020 Villanova del Ghebbo (RO), Italy.
Products must be returned intact, complete with all parts and in their original packaging (bags and boxes), preserved and handled with due care only for the time strictly necessary to establish and verify their nature, characteristics, and size, without signs of wear or dirt, in compliance with the following conditions:

• The right of withdrawal applies to the product in its entirety; it cannot be exercised on partial components (e.g., accessories, fittings, etc.).
• For withdrawal to be valid, the product must be intact and returned in its original packaging, complete in all its parts (including packaging, documentation, tags, labels, seals, etc.).
• Until receipt confirmation at the warehouse designated by 4B12, the shipment remains under the complete responsibility of the Customer.
• In case of transit damage to the returned goods, 4B12 will notify the Customer to allow them to promptly file a claim against their chosen courier and obtain a refund; the product will then be made available to the Customer, automatically canceling the withdrawal request.
• 4B12 shall not be liable in any way for damage, theft, or loss occurring during or in connection with the return shipment.
  4B12 will refund the Customer the full amount already paid, excluding any supplementary shipping costs pursuant to Art. 56, paragraph 2 of Italian Legislative Decree 21/14, within 14 (fourteen) days of withdrawal. The refund will be processed by reversing the charged amount using the same payment method used by the Customer for the initial transaction, unless agreed otherwise. The Customer will not incur any fees as a result of such refund, except for return shipping costs if the standard return procedure was not used or if the return originates outside Italy. 4B12 may withhold the refund until the returned product is received or until the Customer demonstrates that the product has been dispatched, whichever is earlier.

The Customer shall forfeit the right of withdrawal in cases where 4B12 verifies that:

• the returned product, its accessories, and/or its packaging are not intact.
• the product is missing its original external packaging and/or internal wrapping.
• the product is missing essential components and/or accessories (e.g., fasteners, laces, buckles, etc.).
• the disposable single-use seal is missing.

In cases where the right of withdrawal is forfeited, 4B12 will return the purchased product to the sender, charging them for the shipping costs and, if already refunded, the item's purchase price.

Art. 6 – Legal Warranties
All products sold by 4B12 are covered by a 24 (twenty-four) month warranty for lack of conformity, pursuant to Title III of Italian Legislative Decree 206/2005. To benefit from warranty assistance, the Customer must retain the invoice or payment receipt together with the shipping document.
The conformity warranty shall apply provided the product has been used correctly, in accordance with its intended purpose and instructions for use and washing supplied with or on the product.
If, for any reason, 4B12 is unable to provide the Customer with a product under warranty (repaired or replaced), or if repair or replacement is excessively burdensome relative to the product's value, 4B12 may issue an appropriate price reduction or refund the full amount paid, terminating the contract.
In cases where the warranty application requires the return of the product, the Customer must return it in its original packaging, complete in all its parts (including packaging, documentation, and accessories).

Art. 8 – Privacy Policy
Personal data collected upon placing the Order will be processed by 4B12 solely to fulfill the express requests of the Customer, in compliance with Italian Legislative Decree 196/2003 and the Privacy Policy available on the Site. Any further data processing will be carried out exclusively with the Customer's explicit consent.

Art. 9 – Applicable Law and Jurisdiction
The contract of sale governed by these Conditions and its execution is regulated by Italian Law, excluding conflict of law rules. Any disputes arising hereunder shall fall under the jurisdiction of the Court of the municipality where Brand 4B12 has its registered office. Furthermore, the European Online Dispute Resolution (ODR) portal is available at http://ec.europa.eu/consumers/odr/

Art. 10 – Copyright
Trademarks, logos, and other distinctive signs present on the Site belong to their respective owners. The unauthorized use, reproduction, or distribution of trademarks, logos, and distinctive signs on other websites by third parties is strictly prohibited. Site contents (texts, images, and graphics) are protected by copyright laws.

Art. 11 – Entire Agreement
This contract supersedes all previous agreements, arrangements, and understandings between the parties and constitutes the entire agreement between the parties regarding its subject matter, together with the Order, the general terms of website use, and terms relating to the registration service. Any variation or modification to the contract must be accepted in writing by both parties.

Art. 12 – Notices and Communications
All communications between the parties must be made in writing and sent to the address of the other party specified in the contract and Order. Written communications include electronic mail messages sent to the email address of the other party specified on the Site and in the Order. Notices regarding the validity or existence of this agreement must be delivered exclusively by hand or sent by Registered Mail with Return Receipt.
